David Cook Biography

Despite his musical background playing with the band Axium and self-releasing the album Analog Heart, this scruffy 25-year-old bartender from Missouri had never planned to audition for American Idol; he merely showed up at the open call with his auditioning younger brother, Andrew. Andrew did not make it through, but David actually made it all the way to the top, winning over viewers with rocked-out covers of Michael Jackson, Mariah Carey, and Michael Jackson songs and subsequently beating out frontrunner David Archuleta in a bit of a finale upset. David's debut single, the coronation ballad The Time Of My Life, immediately went to number one on the iTunes chart. He is going out on the American Idols Live tour in summer '08, and is expected to release his major-label debut this year on BMG. Written by Lyndsey Parker

Upon receipt of the information included in the Consultation & Artist Info Package, Buyer agrees that ERG has fulfilled its obligations under this agreement and releases ERG from any and all liability to the maximum extent allowed by law, and will indemnify and hold harmless ERG, its directors, officers, employees, and agents, from and against any and all claims arising from this agreement and subsequent event including but not limited to all third party claims, losses, damages, suits, fees, judgments, costs and expenses (collectively referred to as 'Claims'), including attorneys' fees incurred in responding to such Claims, that the parties may suffer or incur arising out of or in connection with (a) a party’s negligence, willful misconduct, or breach of any representation, warranty, or other obligation under this Agreement, or (b) any personal injury (including death) or damage to property resulting from a party or its agents' acts or omissions and standard force majeure. The parties will give prompt notice of any Claim to the other party, and the parties will defend the opposing party at their request. This Agreement will be governed by, construed and enforced in accordance with the laws of the State of NEVADA.
