David Archuleta Biography

Seventeen-year-old David Archuleta was the first runner-up in the seventh season of American Idol, losing to David Cook by 12 million votes at the May 2008 finale. However, for much of the season the former Star Search winner and child prodigy was considered the competition's frontrunner, particularly after his moving performance of John Lennon's Imagine. Simon had called season 7's final David-vs.-David showdown a total knockout in Archuleta's favor, and many viewers were surprised when he lost. However, he has already had several top 10 songs on iTunes, is going out on the American Idols Live tour in summer '08, and is expected to release an album this year on BMG, just like all second-placers that came before him. Upon receipt of the information included in the Consultation & Artist Info Package, Buyer agrees that ERG has fulfilled its obligations under this agreement and releases ERG from any and all liability to the maximum extent allowed by law, and will indemnify and hold harmless ERG, its directors, officers, employees, and agents, from and against any and all claims arising from this agreement and subsequent event including but not limited to all third party claims, losses, damages, suits, fees, judgments, costs and expenses (collectively referred to as 'Claims'), including attorneys' fees incurred in responding to such Claims, that the parties may suffer or incur arising out of or in connection with (a) a party’s negligence, willful misconduct, or breach of any representation, warranty, or other obligation under this Agreement, or (b) any personal injury (including death) or damage to property resulting from a party or its agents' acts or omissions and standard force majeure. The parties will give prompt notice of any Claim to the other party, and the parties will defend the opposing party at their request. This Agreement will be governed by, construed and enforced in accordance with the laws of the State of NEVADA.
